Terms & Conditions
Membership of the InDepth Dive Club and the participation in any club activity, trip, holiday, excursion or use of any club equipment, the club RHIB (boat) is subject to the following Terms & Conditions as well as the club's Constitution and its members Code of Conduct.
Courses
InDepth Dive Club courses are only available to fully paid up members of InDepth Dive Club. Membership of the dive club is a requirement to take part in any course, workshop or training activity. The only exception to this would be any SAA Try-A-Dive or PADI DSD (Discover Scuba Diving)
All course bookings are subject to these terms and conditions. All activities are subject to availability of instructors, equipment, suitable dive site(s) and may be weather dependant.

InDepth Dive Club may accept or decline any booking(s), and may withdraw any offer, discount or promotion at any time, at our discretion. Your booking shall only be accepted when InDepth Dive Club have received the amounts due upon booking from you, and have issued you with an acknowledgement of booking.
PRICING, OFFERS, DISCOUNTS AND PROMOTIONS
Quality doesn't come cheap! But quality training doesn't have to cost the Earth either! Training through a recognised SAA / PADI club can offer significant financial savings, over that of a commercially run course, as none of our instructors are paid! They are all volunteers and give freely of their time to help train you.
​
However, they will be reimbursed their out-of-pocket expenses, travel costs, site entry fees, gas etc.
​
And the club operates a £20 levy per student, per course, to go towards the cost of the club's insurance policies.
We/your instructor may issue you with an estimate of costs from time to time. Such estimates are for guidance only and shall be valid for seven days unless a shorter period is specified by either InDepth Dive Club or your instructor, and this shall not constitute an offer.
​
Try-A-Dive(s) and DSDs (Discover Scuba Diving Experiences) are the only activities open to non-members. The cost of these experiences are published on the website and are subject to change without prior notice and at the discretion of InDepth Dive Club.
COURSE COSTS
Inland dive site entry fees, hardboat fees, club RHIB costs and any transportation costs are not included in any price.

Your place on a course is only confirmed following receipt of a written acknowledgement to your instructor and your undertaking to cover the costs / expenses advised.
​
What is not included in your course price will be communicated to you by your instructor.
INSTRUCTOR EXPENSES
Club members engaging on any course(s) through the club will be required to reimburse their instructor(s) and any assistants, (support diver, surface cover) with their out-of-pocket expenses. These will be discussed in advance and your instructor will give you a guide as to how much you can expect the expenses to be. Expenses would include things like travel costs, site entry fees, gas.
USE OF OWN EQUIPMENT
Any club member / diver using their own scuba diving equipment does so at their own risk and must confirm that they have completed a pre-dive safety check of all of their own equipment and that it has been serviced in accordance with the manufacturer's recommendations and any required legislation for inspection and/or service. InDepth Dive Club accepts no responsibility for loss or damage resulting from club members / divers using their own scuba diving equipment.
FIT TO DIVE
Any club member / student / diver wishing to take part in any InDepth Dive Club course or tag along for a dive or trip MUST complete a Recreational Scuba Training Council (RSTC) Medical Statement, available HERE. The club member / student (or parent/guardian) must fill in the RSTC medical statement participant record (pages one and two), ticking the answers 'Yes' or 'No' where indicated.

If a club member / student provides a YES answer to any question on page one of the RSTC Medical Statement then they must also complete the relevant sections on page 2 and if the club member / student / diver answer 'Yes' to any questions on page 2 then they CANNOT take part in any in-water activities (including pool activities) until the entire document has been reviewed and completed by a suitable physician/GP and they have been signed-off as 'fit to dive' on the RSTC Medical Statement.
This RSTC Medical Statement is valid for one year unless your medical circumstances change within that period, whereupon a new form / sign-off from GP/Physician may be required.

If the form is incorrectly filled in, then a new form must be correctly filled in, and a sign-off may be required from the physician/GP.

CERTIFICATION
Certification at the end of course is NOT guaranteed, all courses run by InDepth Dive Club are performance based and dependent on the student being able to prove understanding of the theory and demonstrating 'skill mastery' of the required skills. Some students may take longer than the allocated time set for any given course.
InDepth Dive Club / your instructor will do their best to ensure all courses finish on time, however due to students learning at different rates courses can (and do occasionally) overrun. We would therefore recommend that you leave yourself extra time at the end of the stated course or agreed completion schedule, in case this should be necessary.

InDepth Dive Club is committed to all of its members / students and therefore we will provide whatever reasonable training is required to complete your course(s) at minimal extra cost. However, please note that if any course requires one-to-one tuition then the costs may increase as a consequence as a single person will be covering the associated expenses.
TRAINING
Club members / students agree to be present at all training sessions between the times communicated. If a student is late for the beginning of any session the course will begin in their absence and any additional training required may incur additional cost(s).
​
Failure to participate in any pool / classroom session(s) or course dives will result in additional cost(s). If a member / student does not meet the performance requirements, as set-out by the training agency, during a booked course this will result in extra cost if another dive(s) have to be arranged.
​
Students under 18 years of age are required to be accompanied by a parent/guardian for all elements of their course(s). The parent/guardian must sign any required paperwork, and should the accompanying adult change during the course, then the new parent/guardian must sign new copies of the paperwork.
ADDITIONAL COURSE DETAILS
Club members / students must agree to make adequate travel arrangements to ensure they arrive before the course start time(s). This includes any necessary route planning, downloading maps of locations, checking public transport, allowing for traffic etc.

Where part of the content of a course is held outside, and due to inclement weather that part of the course cannot be held, or is delayed, cut short, or changed, then InDepth Dive Club / your instructor will not be responsible for any consequential loss or damage or expense incurred as a result.
​
The cost of any hardboat usage is extra to the course fee. This amount is payable to boat operators and must be paid at the agreed times.
​
The cost of any club RHIB usage must also be paid at the agreed times, regardless of whether or not the dives / course(s) take part. Costs are incurred in towing the RHIB and these must be reimbursed.
​
It is a mandatory requirement that club members / students have their own training materials for each PADI / SAA course. These materials are included in your course fees unless otherwise stated. Please ensure you bring these materials to each session. Course materials will be sent out to you or be available for collection by arrangement once they have been paid for.
​
Where applicable, please allow enough time for self-study and completion of the required pre-study materials and knowledge reviews etc in advance of the course start date, ready for submission at the start of the course. Failure to do so may incur re-scheduling along with associated additional cost(s).
​
Full payment of any course costs and instructor expenses must be received on completion of the course according to the originally agreed schedule for completion. If, for whatever reason, a student is unable to complete a course within the originally agreed schedule, full payment must be received on the originally agreed date. If additional training / rescheduling is required, this will need to be discussed with your instructor, please note this may incur additional cost(s).

All courses must be completed within a 12 month period of starting otherwise all course fees are forfeit. Where a course has not been completed and the 12 month period has elapsed the course will have to commence again from the start, unless otherwise agreed with your instructor.
REFUND POLICY
It is not our policy to issue refunds, a course can be rescheduled to an alternative date, but a fee may apply. This includes courses that are partially completed.

We cannot offer refunds due to the nature in which the club operates. Course materials are ordered on request and can not be returned and therefore cannot be refunded. Likewise, our instructors are not paid, they are volunteers and they are reimbursed their out-of-pocket expenses, therefore these cannot be refunded either.
Trips, Holidays, Excursions & Social Events
InDepth Dive Club trips, holidays, excursions and social events are only available to fully paid up members of InDepth Dive Club and their guests. Membership of the dive club is a requirement to take part in any overseas holiday. Guests may attend one UK dive trip before membership of the club is required to attend further trips.
All trips, holidays, excursions and social events are subject to these terms and conditions. All activities are subject to availability of suitable dive site(s) and may be weather dependant. Tour Operators and Travel Agents will apply their own Terms & Conditions which you will also be bound by.

When booking any trip / excursion, the person booking the place is committed to pay the cost of that place. If, for whatever reason, you cannot fill a space you have previously booked, InDepth Dive Club will endeavor to fill that space, but if it cannot be filled then the cost remains your responsibility.
HARDBOAT TRIPS
When booking a spot on any hardboat trip, the person booking the place is committed to pay the cost of that place. If you have booked a single spot for yourself then it is your responsibility to fill that spot if you cannot then attend. You will still be liable for the full cost of that spot even if you do not attend and cannot fill the spot.

If, having booked multiple spots, you cannot fill a space(s) for whatever reason, you have previously booked, InDepth Dive Club will endeavor to fill that space, but if it cannot be filled then the cost remains your responsibility.

CLUB RHIB DIVES
When booking a spot on any club RHIB dive day(s), the person booking the place is committed to pay their share of the cost of that place. If you have booked a spot for yourself then it is your responsibility to fill that spot if you cannot then attend. You will still be liable for the full cost of that spot even if you do not attend and cannot fill the spot.

SOCIAL EVENTS
When booking a spot on any social event, the person booking the place is committed to pay the cost of that place. If you have booked a spot for yourself then it is your responsibility to fill that spot if you cannot then attend. You will still be liable for the full cost of that spot even if you do not attend and cannot fill the spot.

If, having booked multiple spots, you cannot fill a space(s) for whatever reason, you have previously booked, InDepth Dive Club will endeavor to fill that space, but if it cannot be filled then the cost remains your responsibility.

HOLIDAYS
When booking a spot on any club holiday, the person booking the place is committed to pay the cost of that place. If you have booked a spot for yourself then it is your responsibility to fill that spot if you cannot then attend. You will still be liable for the full cost of that spot even if you do not attend and cannot fill the spot.

If, having booked multiple spots, you cannot fill a space(s) for whatever reason, you have previously booked, InDepth Dive Club will endeavor to fill that / those space(s), but if it / they cannot be filled then the cost remains your responsibility.
​
PLEASE NOTE - Deposits for overseas trips and holidays are required and are non-refundable.
A typical deposit is 20%.

Any club holiday booked will also be subject to the terms & conditions of any tour operator, travel agent, airline, resort or hardboat that provides services. You will be bound by their terms & conditions as well as any set out by InDepth Dive Club.
REFUND POLICY
It is not our policy to issue refunds. We are not able to offer refunds on club trips, excursions, holidays and social events due to the nature in which the club operates. When you book a spot on any of these events you accept that you have to pay for it and that if you cannot then go, for whatever reason, you still have to pay for it.
​
It is not fair or reasonable to book a spot, and in so doing deny that spot to others, and then cancel at the last minute and expect InDepth Dive Club to fill your spot and/or other club members to pay more to cover your spot.
​
This policy is made clear at the time of booking and all bookings on all trips, holidays, excursions and social events are taken subject to these terms & conditions and this refund policy.

Gift Vouchers
Below are the basic Terms & Conditions for InDepth Dive Club's Gift Vouchers
1. There can be only one voucher per order or transaction.
2. Vouchers are non-refundable and cannot be exchanged for cash.
3. Vouchers are valid for 12 months from date of purchase. Purchase date is written on the front of the voucher.
4. Vouchers can only be used if a minimum order amount is met (excluding postage costs). The minimum order amount will be shown on / with the voucher.
5. If you would like to place an order that is worth more than your voucher amount, you can pay for the difference using cash, Visa or Master Card.
6. If the voucher is worth more than the order, the difference will not be refunded and cannot be applied to a future order; therefore if you do not use the entire voucher amount, the difference will be lost.
8. Some vouchers can only be redeemed on specific training, items or groups of items. As stated on the voucher.
9. Diving experiences & training are subject to medical fitness. You will be required to complete a medical form prior to engaging in any diver training / experience.
10. Should a diving experience / training be cancelled by InDepth Dive Club for any reason an alternative date will be provided.
11. Without the permission of InDepth Dive Club, it is not permitted to sell, trade or purchase vouchers in any way.
12. InDepth Dive Club reserves the right to discontinue a voucher at any time or to modify any vouchers’ terms and conditions.
CLUB MEMBERSHIP VOUCHERS
We offer a specific Gift Voucher for club membership. This voucher is valid from the date of purchase for that membership year and membership will expire at the end of March the following year.

Annual membership Gift Vouchers bought as Christmas presents or at the start of a year will run until the end of March for the following year, effectively giving up to 15 months membership.

MONETARY VALUE GIFT VOUCHERS
You can purchase amount specific Gift Vouchers, subject to the general terms & conditions stated above. Please state the monetary value you wish to purchase and we will produce a Gift Voucher specifically for that amount. Minimum £20.

PRICES

AVAILABILITY OF GOODS
All orders are accepted subject to the availability of goods and services. If for any reason any particular product or item is not available we shall try to offer a suitable alternative. If we cannot we reserve the right to cancel the contract and offer a refund.
STOCK
We do not typically hold stock of third party goods. Items are ordered specifically on request and, as such, need to be delivered to us first.

Consequently items can take a few weeks to arrive from date of order.

We shall give you an estimated date for the delivery of the goods and services. If this date cannot be achieved we shall keep you informed of the delay and provide a new estimate of the date of delivery. RISK
The risk in the goods supplied by us shall pass to you after delivery of them has taken place.
PAYMENT
Payment for the goods and services supplied by us is due prior to delivery or immediately following the submission of order and/or our invoice whichever is earlier and that date shall be the due date.

We do not offer accounts to any party. All goods shall be paid for at time of placing order.

We reserve the right to cancel any contract if you fail to pay any amount due to us.

OWNERSHIP OF GOODS
We shall retain title in the goods until payment has been made to us in full. Until we have received full payment you agree to take reasonable care of the goods.

Any rejection of the goods must be notified to us by you within seven days of the date of their delivery.
LIABILITY
We shall not be liable to you if we cannot fulfil our obligations under this contract due to some circumstance or event outside of our control, such as an Act of God, war, riot, fire etc.

It is agreed that the Contract (Rights of Third Parties) Act 1999 (or any repealing measure) shall not apply to this agreement and nothing in this agreement is intended to confer any benefit upon or create rights in favour of any party other than you and us.

Our liability for negligence for death or personal injury shall be unlimited as required by law. We shall have no liability for any other kind of consequential loss or damage and in any other case our liability shall be limited.
OTHER SERVICES
If you order other services then these orders shall be governed by our supplementary terms of business and those terms will control the performance of all field services.
DISTANCE SELLING ACT
If you are a consumer, you should be aware of your rights under the Distance Contracts Regulations 2000 (or any amending provisions). These state, amongst other things, that you have the right to cancel the contract for any reason within seven days of delivery of the goods. If you wish to cancel, please notify us in writing to our address.

You will then be refunded within thirty days of returning the goods to us, although this will be at your cost and if we have to collect them we will deduct the collection costs from the refund paid to you. During the period that you retain the goods until they are returned to us, you must take reasonable care of them to prevent damage.
This guarantee does not affect your statutory rights.
GDPR
Data protection principles
InDepth Dive Club is committed to processing data in accordance with its responsibilities under the GDPR.
Article 5 of the GDPR requires that personal data shall be:

1. Processed lawfully, fairly and in a transparent manner in relation to individuals;

2. collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes; further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall not be considered to be incompatible with the initial purposes;

3. adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;
​
4. accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay;

5. kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes subject to implementation of the appropriate technical and organisational measures required by the GDPR in order to safeguard the rights and freedoms of individuals; and

6. processed in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures.”
GENERAL PROVISIONS
1. This policy applies to all personal data processed by the club.

2. The Responsible Person shall take responsibility for the club’s ongoing compliance with this policy.
​
3. This policy shall be reviewed at least annually.
LAWFUL, FAIR & TRANSPARENT PROCESSING
1. To ensure its processing of data is lawful, fair and transparent, the club shall maintain an up-to-date privacy policy.
​
2. The privacy policy shall be reviewed at least annually.
​
3. Individuals have the right to access their personal data and any such requests made to the club shall be dealt with in a timely manner.
LAWFUL PURPOSES
1. All data processed by the club must be done on one of the following lawful bases: consent, contract, legal obligation, vital interests, public task or legitimate interests (see ICO guidance for more information).
​
2. The club shall note the appropriate lawful basis in the Register of Systems.
​
3. Where consent is relied upon as a lawful basis for processing data, evidence of opt-in consent shall be kept with the personal data.
​
4. Where communications are sent to individuals based on their consent, the option for the individual to revoke their consent should be clearly available and systems should be in place to ensure such revocation is reflected accurately in the club’s systems.
DATA MINIMISATION
1. The club shall ensure that personal data are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.
ACCURACY
1. The club shall take reasonable steps to ensure personal data is accurate.

2. Where necessary for the lawful basis on which data is processed, steps shall be put in place to ensure that personal data is kept up to date.
ARCHIVING / REMOVAL
1. To ensure that personal data is kept for no longer than necessary, the club shall put in place an archiving policy for each area in which personal data is processed and review this process annually.
​
2. The archiving policy shall consider what data should/must be retained, for how long, and why.
SECURITY
1. The club shall ensure that personal data is stored securely using modern software that is kept-up-to-date.
​
2. Access to personal data shall be limited to personnel who need access and appropriate security should be in place to avoid unauthorised sharing of information.
​
3. When personal data is deleted this should be done safely such that the data is irrecoverable.
​
4. Appropriate back-up and disaster recovery solutions shall be in place.
BREACH
In the event of a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data, the club shall promptly assess the risk to people’s rights and freedoms and if appropriate report this breach to the ICO (more information on the ICO website).
